Independent trade unions are now banned in the so-called Luhansk Peoples Republic’ – the Order was issued on 20th January2015 by the Minster of Justice A.V. Shubin entitled: “Concerning the Ban for Registration of Independent Trade Unions on the Territory of the People’s Republic of Luhansk Peoples Republic”. The order has become fully apparent as when an attempt was made by the Indepenent Miners Union sought to register at the Barakov Coal Mine. 
The record of trade union rights in the territory under the control of the Russian para-military forces of the Donetsk Peoples Republic and the Luhansk Peoples Republic is abyssmal. Both the Federation of Trade Unions of Ukraine and the Confederation of Free Trade Unions have recorded extensive human rights violations against their unions. Most recently Ivan Reznichenko the leader of the Independent Miners Trade Union of Ukraine (NGPU) at the state enterprise “Artemsil” in Donetsk oblast was murdered by the pro-Russian separatists. Meanwhile miners wages and holidays have been cut, where wages are actually being paid. Whilst existing trade unions are being banned a number of yellow unions have been set up – none of them are genuine trade unions.

DECISION
to deny the procedure for state registration of a legal entity
On 16.01.2015 the Chairman of the Independent Miners’ Union of the Barakov Coal Mine submitted documents to the Section for State Registration of Legal and Physical Entities – Entrepreneurs, Non-Governmental Associations and Mass Media, seeking a state registration for a physical entrepreneurial entity. In the course of reviewing the submitted documents, the State Registrar established that the documents in question were not in compliance with the effective legislation, in particular:
In accordance with the Order of the Minster of Justice A.V. Shubin No 8-ОД “Concerning the Ban for Registration of Independent Trade Unions on the Territory of the People’s Republic of Luhansk” dated 20.01.2015, as well as in accordance with Items 1, 2 of Article 25 of the Law of the People’s Republic of Luhansk “On State Registration of Legal and Physical Entrepreneurial Entities”, the State Registrar took the decision to deny the procedure for state registration of the legal entity.
This decision does not constitute grounds for denying re-submission of documents for state registration of a legal entity.
